Terms of Service

These terms govern your use of Watsell, a product of Bered, registered in Iraq as شركة الخط الأحمر للدعاية والإعلان (Al-Khat Al-Ahmar Company for Advertising and Publicity), Baghdad. By creating an account or using the service you accept them. If you do not accept them, do not use the service.

بالعربية: تحكم هذه الشروط استخدامك لـ Watsell، وهو أحد منتجات Bered، المسجلة في العراق باسم شركة الخط الأحمر للدعاية والإعلان، بغداد. وبإنشائك حساباً أو باستخدامك الخدمة تكون قد قبلت هذه الشروط. وإن لم تقبلها فلا تستخدم الخدمة.

By using Watsell you agree to comply with the WhatsApp Business Policy and the Meta Platform Terms. These are set by Meta, not by us, and they can change without our involvement.

بالعربية: باستخدامك Watsell توافق على الالتزام بسياسة واتساب للأعمال وبشروط منصة Meta، ورابطاهما واردان في النص الإنكليزي أعلاه. وهذه القواعد تضعها Meta لا نحن، وقد تتغير من دون تدخل منا.

If your shop connects a TikTok business account, TikTok’s own terms and messaging rules apply to your TikTok conversations as well. TikTok does not let a business message a customer first, limits how many messages a business may send after each customer message, and enforces those limits itself. These rules are set by TikTok, not by us, and they can change without our involvement.

بالعربية: إذا ربط محلك حساب تيك توك للأعمال، فإن شروط تيك توك وقواعد المراسلة الخاصة به تسري أيضاً على محادثاتك في تيك توك. ولا يسمح تيك توك للنشاط التجاري بأن يبدأ مراسلة العميل، ويحدّ من عدد الرسائل التي يرسلها بعد كل رسالة من العميل، ويطبّق هذه الحدود بنفسه. وهذه القواعد يضعها تيك توك لا نحن، وقد تتغير من دون تدخل منا.

You are responsible for the content sent through your account, including messages generated by the assistant on your instructions. You must have a lawful basis for messaging the people you message.

Sending unsolicited bulk messages, or otherwise breaching WhatsApp policy, will result in suspension of your account. We may suspend immediately and without notice where we believe continued use puts other customers or our Meta access at risk.

بالعربية: أنت المسؤول عن المحتوى الذي يُرسل عبر حسابك، ومنه الرسائل التي يولّدها المساعد بناءً على تعليماتك، وعليك أن تستند إلى أساس قانوني في مراسلة من تراسلهم. وإرسال رسائل جماعية غير مطلوبة، أو أي خرق آخر لسياسة واتساب، يؤدي إلى إيقاف حسابك. ولنا أن نوقفه فوراً ومن دون إشعار متى رأينا أن استمرار الاستخدام يعرّض بقية المحال أو وصولنا إلى Meta للخطر.

Watsell generates replies using an automated language model. Its output can be wrong. You are responsible for reviewing what it tells your customers and for configuring your knowledge base accurately.

We do not guarantee that a reply will be accurate, appropriate, or suitable for any particular purpose, and we are not party to any agreement the assistant appears to make on your behalf.

بالعربية: يولّد Watsell الردود بنموذج لغوي آلي، وقد تكون ردوده خاطئة. وأنت المسؤول عن مراجعة ما يقوله لعملائك وعن ضبط قاعدة معرفتك بدقة. ولا نضمن أن يكون الرد دقيقاً أو مناسباً أو صالحاً لأي غرض بعينه، ولسنا طرفاً في أي اتفاق يبدو أن المساعد أبرمه نيابةً عنك.

Watsell is a software provider. We are not responsible for action Meta takes against your WhatsApp Business account, your Facebook Page, or your access to their APIs, including suspension or permanent ban, whether or not it results from how you use our platform.

بالعربية: Watsell مزود برمجيات، ولا نتحمل مسؤولية أي إجراء تتخذه Meta ضد حسابك على واتساب للأعمال، أو صفحتك على فيسبوك، أو وصولك إلى واجهاتها البرمجية، ويشمل ذلك الإيقاف أو الحظر الدائم، سواء أكان هذا الإجراء ناتجاً عن استخدامك لمنصتنا أم لم يكن.

We aim to keep the service running but do not guarantee uninterrupted availability. The service is built on third parties, including the messaging platforms it connects to, the providers that generate replies and transcribe voice notes, and the providers that host the application and store its data. An outage or a policy change at any of them can disrupt the service, and those are outside our control. Our privacy policy describes what data reaches each kind of provider.

بالعربية: نسعى إلى إبقاء الخدمة عاملة، غير أننا لا نضمن استمرارها من دون انقطاع. فالخدمة مبنية على أطراف ثالثة، منها منصات المراسلة التي تتصل بها الخدمة، والمزودون الذين يولّدون الردود ويحوّلون الملاحظات الصوتية إلى نص، والمزودون الذين يشغّلون التطبيق ويخزّنون بياناته. وأي عطل أو تغيير في السياسة لدى أي منهم قد يعطّل الخدمة، وذلك خارج عن سيطرتنا. وتبيّن سياسة الخصوصية البيانات التي تصل إلى كل فئة من فئات المزودين.

Subscription fees are payable in advance and are non-refundable, including for partial periods and for accounts suspended for breach of these terms. We will give notice before changing prices.

بالعربية: تُدفع رسوم الاشتراك مقدماً وهي غير قابلة للاسترداد، ويشمل ذلك الرسوم المدفوعة عن الفترات الجزئية وعن الحسابات الموقوفة بسبب خرق هذه الشروط. وسنُشعرك قبل تغيير الأسعار.

You may stop using the service and close your account at any time. We may terminate or suspend an account that breaches these terms. On termination you can request deletion of your data as set out in the Privacy Policy.

بالعربية: يمكنك التوقف عن استخدام الخدمة وإغلاق حسابك في أي وقت. ولنا أن ننهي أو نوقف أي حساب يخرق هذه الشروط. وعند الإنهاء يمكنك طلب حذف بياناتك على النحو المبيّن في سياسة الخصوصية، ورابطها وارد في النص الإنكليزي أعلاه.

To the extent permitted by law, our total liability arising from the service is limited to the fees you paid in the three months before the claim. We are not liable for lost profits, lost business, or indirect losses.

بالعربية: بالقدر الذي يسمح به القانون، تقتصر مسؤوليتنا الإجمالية الناشئة عن الخدمة على الرسوم التي دفعتها في الأشهر الثلاثة السابقة للمطالبة. ولا نتحمل مسؤولية الأرباح الفائتة أو فوات الفرص التجارية أو الخسائر غير المباشرة.

These terms are governed by the laws of the Republic of Iraq, and the courts of Baghdad have exclusive jurisdiction.

بالعربية: تخضع هذه الشروط لقوانين جمهورية العراق، وتكون لمحاكم بغداد الولاية القضائية الحصرية.
